Important info
During the times of

you are permitted to bring babi with you as long as they are secure at all times.
If in the event of staff leave this permission will be taken away as per safeguarding policies. You will be contacted if this shall arise.

Fitness Class Packages
All fitness packages MUST be purchased by the 5th of the month - they are a flat rate and cannot be pro-rata.
Failure to purchase by the 5th & you still wish to come to a fitness class you can still do so via the PAYG (pay as you go) option.
Maximum capacity for our classes is 12, apart from our Mens Only Class, the max capacity is 6.

Clwb Fitness is commited to protecting and respecting your privacy. This policy together with our Terms and Conditions sets out how Clwb Fitness uses and protects any information that you give us when you use this site.
Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.
By personal data we refer to information collected or held by Clwb Fitness and relates to you as an individual. For the purpose of the Date Protection Act 1998, the general protection regulations and any other applicable data protection and privacy laws and regulations (data protection legislation) Clwb Fitness will be the “data controller”.
Whenever you provide personal information, we are legally obliged to use it in accordance with the laws concerning the protection of personal information.
When we may collect your personal data
Information we may collect
Identity Data includes first name, maiden name, last name, username or similar identifier, marital status, title, family and lifestyle information, date of birth and gender.
Contact Data includes address, billing address, emergency contact details, email address and telephone numbers.
Financial Data includes bank account and payment card details.
Transaction Data includes details about payments to and from you and other details of products and services you have purchased from us.
Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website.
Profile Data includes your username and password, purchases or orders made by you, your interests, preferences, feedback and survey responses.
Usage Data includes information about how you use our website, products and services.
Marketing and Communications Data includes your preferences in receiving marketing from us and your communication preferences.
If you fail to provide personal information
Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.
How we use your personal data
We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:
Where we need to perform the contract we are about to enter into or have entered into with you. Where it is necessary for our legitimate interests and your interests and fundamental rights do not override those interests. Where we need to comply with a legal or regulatory obligation. Generally we do not rely on consent as a legal basis for processing your personal data other than in relation to sending third party direct marketing communications to you via email or text message. You have the right to withdraw consent to marketing at any time by contacting us.
Below are some of our legitimate interests:
CCTV
We process information from CCTV of outside both exits and both sides of the gym floor. No camera does infringe on sensitive areas.
This section sets out the appropriate actions and procedures which Clwb Fitness follows in respect of the use of CCTV (closed circuit television) in our Gym.
Please note that all our gyms are monitored by CCTV 24 hours a day. Clwb Fitness reserves the right for its employees and contractors to review footage as required and by entering onto our sites you consent to your image being recorded and reviewed and waive any and all claims in relation to same. Recorded CCTV footage will be stored securely and retained in compliance with applicable laws.
Our CCTV is actively being monitored in unstaffed hours between 8pm and 8am by our internal CCTV team.
The processing of CCTV will be handled in accordance with the Data Protection Regulations, The CCTV Code of Practice, and the Human Right Act 1998.
The purpose of the use of the CCTV Systems and the collection and processing of CCTV images is for the prevention or detection of crime or disorder, apprehension, and prosecution of offenders (including use of images as evidence in criminal proceedings), interest of public and employee Health and Safety, protection of public health and the protection of our property and assets and to ensure compliance with our policies and procedures.
Clwb Fitness processing of CCTV is necessary for the legitim interest in monitoring the gym as part of the implementation of security measures and to be able to exercise or defence a legal claim
Prior to any camera installation Clwb Fitness will ensure that the installation complies with this policy and that the use of any camera is justified, necessary and proportionate. Clwb Fitness will regularly assess whether the use of any camera and the CCTV System as a whole continues to be justified, necessary and proportionate.
The recordings are reviewed by random checks, specific suspicions, or other irregularities.
All images are digitally recorded and stored securely within the system’s hard drives. Images are stored for 30 days, unless longer storage is allowed under legislation.
All access to and disclosure of recorded CCTV images is restricted and carefully controlled. Access to and disclosure of CCTV is permitted only if it supports the purpose for which such images have been collected. Disclosure of CCTV from third parties, e.g. a police enquiry or investigation, needs to be supported by a DPA- or consent form from the registered person on the images.
Opting Out
You can ask us to stop sending you marketing messages at any time by contacting us via email – clwbfitness@hotmail.com. Where you opt out of receiving the marketing messages, this will not apply to personal data provided to us as a result of product/service purchase, product/service experience or other transactions.
Legal basis of processing
We will only process your information for as long as we have a relevant legal basis to do so. This is usually in order to provide you with the services you have requested from Clwb Fitness or if you have provided us with adequate consent to process your information for other purposes. If we choose to process your information under the legal basis of legitimate interests, we will always inform you of out legitimate business interest and your right to object
Sharing your information with others
Please be assured that we will not share your information unless we are required by law or permitted to do so under this privacy policy. The main circumstances in which we will be permitted or required to disclose this is by law will be by court order, to government bodies and law enforcement agencies. Permitted under this policy is the sharing of your information with our chosen membership software and booking system. this is a carefully selected sub-processor to help us collect, store and manage your information.
International Transfers
We shall not transfer any personal data to any country outside of the European Economic Area unless we ensure that such personal data is subject to an adequate level of protection and appropriate legal safeguards in accordance with Date Protection Legislation.
Data security
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to employees and third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality. We will notify you and any applicable regulator of a breach where we are legally required to do so.
How long will you use my personal data for?
We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. By law we have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they cease being customers for tax purposes. In some circumstances you can ask us to delete your data: In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.
Access to your personal data
You have rights in relation to any personal data we hold about you. You have the right to:

Clwb Fitness will require a confirmation of your ID prior to providing any information aboutthe data we hold. If you are unable to provide sufficient information to prove your ID, Clwb Fitness reserves the right to refuse your request for access to Personal Data.
We try to respond to all legitimate requests within a month. Occasionally it may take us longer if the request is complex or if you have made a number of requests. In that case we will notify you to keep you updated.
Changes to privacy policy
We may change the privacy notice at any time to ensure it always accurately reflects the way we collect, use and safeguard your personal information. Please check this notice from time to time to ensure you are aware of any updates we may have made to our Personal Data handling practices. The date of the changes will be listed in the “last updated” section below.

participant waiver and release of liability
we care about all participants who use this facility. we have taken all necessary precautions to ensure this facility is safe for use during manned and unmanned hours.
inconsideration to clwb fitness services and/or equipment to enable me to participate in the fitness activities i aggree to the following:
risk (1) i fully understand and acknowledge that:
a) risks and dangers exist in my use of the gym and fitness equipment and participation in clwb fitness activities
b) my participation in such activities and/or use of such equipment may result in injury to the body , blindness, heat stroke , heart attack , death or any other ailments that could cause serious injury or disability.
c)these risks and dangers may be caused by the negligence of the participants, the negligence of others, accidents, breaches of contact, the forces of nature or other causes, and
(d) by my participation in these activities and/or use of equipment, I hereby assume all risks and dangers and responsibility for any losses/accidents/injuries/damages to myself and/or my child and/or the facility or equipment provided.
(e) if bringing my baby during the allowed hours they will remain secure at all times and my responsibility.
Abuse of membership (2) I fully understand and acknowledge the following measures, to which if abused, will result in my membership at clwb fitness being reviewed and potentially terminated;
(e) allowing nonmembers to gain access to the club via opening entry doors for them, or by giving access of your entry keyfob to someone else.
(f) Insufficient payments/expired memberships will inhibit restricted access
(g) negligence towards health and safety measures set in place
(h) CCTV is fully operational 24 hours a day for your safety and security whilst on the premises, during manned and unmanned gym hours. Tampering with such equipment is completely forbidden.
(i) Negligent behaviour/violence towards other members/equipment
(j) Stealing or removing shop products or equipment from the gym floor
Unmanned Implications (3) I fully understand the following guidelines apply when the facilities unmanned;
emergency contact number is provided, and are solely to be used in emergency situations, when needing to alert a member of staff and/or emergency services is a priority
I, on behalf of myself’, my personal representatives and my heirs, hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify clwb fitness and its owners, agents, officers and employees from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of service or otherwise which may arise out of my use of clwb fitness equipment or my participation in clwb fitness Activities. I specially understand the future of negligent acts or other conduct by the owners, agents, officers or employees of clwb fitness.
I HAVE READ THE ABOVE WAIVER/RELEASE AND BY joining a membership, fitness class or personal training session i AGREE IT IS MY INENTION TO EXEMPT AND RELIEVE clwb fitness FROM LIABLITILTY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.
GYM RULES:
Membership: a) Termination: Membership may be cancelled after original membership contract length has been completed, and with 30 days notice in advance. A written/email/document (signed and dated) explaining you’re leaving us is acceptable forms of termination.
(b) Your membership allows you to access the club in accordance to the opening times of the facility.
(c) Your membership applies to you; you cannot loan or transfer it to another person, unless permission is granted through the club manager.
(d) If your membership is terminated before the contract length has been completed (by other means that point A), clwb fitness has the right to reclaim the remaining fees via debt collection agency, direct debit or other means of payment.
(e) After your membership contract length has expired, your membership will automatically enrol into a month by month contract, which can be cancelled via point A.
Use your own keyfob entry every time you visit clwb fitness. As it’s personal to you, please don’t let anyone else use it or gain access via it. We monitor access entry usage by CCTV 24/7 to ensure the safety of our members and misuse may result in us applying additional charges to your membership fees OR termination.
On joining all members are offered a comprehensive induction to instruct you on the use of the gym equipment. You are strongly advised to undertake this. clwb fitness will not accept any liability for any claim for personal injury if you use the gym equipment having not undertaken an induction from a qualified member of clwb fitness staff.
Induction bookings although not mandatory can be made via email or message through the booking app/site.
If you are unsure as to how to use any piece of equipment you must seek advice from a qualified member of clwb fitness staff before using such equipment.
Strictly under 16’s are not permitted to use the gym.
For safety reasons, bags are not permitted onto the gym floor and correct attire must be worn when exercising i.e. suitable comfortable exercise clothing and appropriate footwear. Clothing such as flip-flops/sandals or work wear are not permitted. Any member not wearing suitable attire may be asked to leave the gym.
You may not use the gym whilst under the influence of alcohol, drugs, tranquilizers or any medication or other substance which may affect your ability to exercise safely. clwb fitness reserves the right to remove you from the premises if it reasonable believes you are unfit to use the facilities.
As a courtesy to other members, a small gym towel must be carried Or the use of our sanitizing wipes or sprays to wipe down equipment after use.
Can you ensure that you put your weights back in their original place when finished, failure to do so may result in your membership being terminated.
Members are solely responsible for their own belongings whilst visiting clwb fitness. clwb fitness accepts no responsibility for any loss or damage to personal property.
You must not behave in an aggressive, abusive, anti-social or threatening manner to any staff or member, any one doing so will have their membership terminated immediately and clwb fitness reserves the right to contact the Police if deemed necessary.
Gym licensed personal trainers are not permitted to train members in the Gym unless granted express permission in writing from clwb fitness Director. Anyone else undertaking members’ training will be asked to leave the gym immediately.
Although we will always endeavour to return any articles of lost property to the owner, we do not take responsibility for any item held in lost property. Such items will be kept until claimed, but for no longer than two weeks after which time the items will either be donated to charity or destroyed.
the toilet facilities will be open during opening hours.
Members must inform clwb fitness of any change of contact and email address or telephone numbers. These changes can be made via email or on your booking app/site.
By accessing the gym and using the gym equipment members are deemed to have read and understood the terms and conditions of membership.
Should your Physical Activity Readiness Questionnaire (PARQ) result in you being required to discuss your intention to exercise with your doctor, please be aware that your subscription remains active and any fees collected are non-refundable.
Smoking, including e-cigarettes are strictly prohibited in all areas of the gym. Any member found to be breach of this rule may have their membership terminated.
Members may not bring any pets (other than official aid dogs) into the gym.
Please do not misuse the weights by dropping them on the floor, failure to do so may result in your membership being terminated.
Please do not take photographs/videos on the premises or post remarks to the internet that may identify another member failure to comply may result in your membership being terminated.
Cancellation Policy
30 DAYS ADVANCED NOTICE FOR CANCELLATION REQUEST MUST BE SENT IN WRITING
clwb fitness.
Please note that refunds will not be issued for any periods of unused training.
Please allow 7 working days for all
cancellation requests to be processed.
Any scheduled payments during this time will run as normal.
clwb fitness reserves the right to terminate a clients membership immediately without giving a reason. In such cases a pro-rata refund will be issued and the client will no longer be able to attend training or involvement with clwb fitness.
